Introduction

Thank you for using Jack's Tracks, a daily guitar companion app that delivers personalised lessons, song recommendations, and practice tools. Please read these Terms of Service and our Privacy Policy carefully, as you must agree to both in order to have permission to use our Service.

Definitions

Throughout this Agreement, we may use certain words or phrases, and it is important that you understand the meaning of them. The list is not all-encompassing and no definition should be considered binding to the point that it renders this Agreement nonsensical:

• "Agreement" means these Terms of Service.
• "Service" refers to the services we provide through our Site and App, including daily track recommendations, lesson videos, the Jack Says feature, the built-in tuner, metronome, and all other features of Jack's Tracks.
• "Site" refers to our website, www.jackstracks.app.
• "App" refers to the Jack's Tracks web application and any future mobile applications.
• "Jack's Tracks" refers to our company and Service, depending on the context.
• "Content" refers to lesson videos, song recommendations, messages, and other material delivered through the Service.
• "User" refers to any person who creates an account or otherwise uses the Service.
• "You" refers to you, the person entering into this Agreement with Jack's Tracks.

What Jack's Tracks Offers

Jack's Tracks is a daily guitar companion that delivers fresh, personalised content every day. Upon signing up, you tell us your preferred genres, favourite guitarists, and technique focus areas. Each day, Jack curates a song to explore, a lesson video matched to your skill level and focus, and a personal message from Jack — all tailored to your profile. The Service also includes a built-in chromatic tuner and a tap-tempo metronome to support your practice sessions. Users can rate and save content to build a personal history of their guitar journey.

Jack's Tracks is currently offered as a free service. We may introduce optional paid plans in the future. Any changes to pricing will be communicated in advance.

Eligibility

In order to use our Service, you must meet the following conditions:

• You must not be in violation of any embargoes, export controls, or other laws of the United States or other countries having jurisdiction over this Agreement, Jack's Tracks, and yourself.
• You must be the minimum age required to enter into a contract in the area in which you reside, and in any event must not be less than 13 years of age. If you are between the ages of 13 and 18 (or between 13 and the age of legal majority in your jurisdiction), you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Service.
• You must provide accurate and current information when creating your account.

Accounts

When you create an account with us, you guarantee that you are above the age of 13 and that the information you provide is accurate, complete, and current at all times. If you are based in the EEA, you may only use the Service if you are over the age at which you can provide consent to data processing under the laws of your country, or if verifiable parental consent has been provided.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at jack@jackstracks.app upon becoming aware of any unauthorised use of your account or any other breach of security.

You may not use a username that impersonates another person or entity, infringes on any trademark or other intellectual property rights, or is offensive, vulgar, or obscene. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

Rules of Use

In addition to the eligibility criteria above, you must not:

• Violate any applicable local, national, or international laws or regulations.
• Use the Service in any way that is fraudulent, harmful, or deceptive.
• Attempt to gain unauthorised access to any part of the Service, its servers, or any systems connected to the Service.
• Scrape, crawl, or otherwise extract data from the Service by automated means without our prior written consent.
• Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
• Use the Service to transmit any unsolicited or unauthorised advertising or promotional material.
• Do anything else which, at Jack's Tracks' discretion, could bring Jack's Tracks into disrepute or violate the rights of Jack's Tracks or any other person.

Content and Intellectual Property

All Content delivered through the Service — including Jack Says messages, lesson curation, and AI-generated recommendations — is the property of Jack's Tracks or is used with permission. You may not reproduce, distribute, modify, or create derivative works from any Content without our prior written consent.

Embedded video content is sourced from YouTube using YouTube API services. Jack's Tracks does not host or own this video content. Your interaction with YouTube-embedded content is subject to the YouTube Terms of Service and the Google Privacy Policy.

Tab and sheet music links provided through the Service point to third-party websites. Jack's Tracks does not host, own, or warrant the accuracy or availability of any tab content on third-party sites.

YouTube

Some content on the Service uses video players embedded from YouTube via YouTube API services. When interacting with such content, you agree to be bound by the YouTube Terms of Service and the Google Privacy Policy.

Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by Jack's Tracks. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Communications

By creating an account on our Service, you agree to receive transactional emails and, where you have opted in, newsletters or product updates. You may opt out of non-essential communications at any time by following the unsubscribe link in any email we send, or by contacting us at jack@jackstracks.app.

Availability, Errors and Inaccuracies

We are continually improving the Service. Content recommendations are generated using AI and may occasionally be inaccurate, unavailable, or not perfectly matched to your profile. We reserve the right to update, correct, or remove any Content at any time without prior notice. We do not warrant the completeness or accuracy of any Content delivered through the Service.

Trademarks

"Jack's Tracks" and the Jack mascot are trademarks used to uniquely identify our Site, Service, and brand. You agree not to use these marks, our trade dress, or any confusingly similar branding without our prior written consent. You agree not to copy the look and feel of our website or application without our prior written consent.

Representations & Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. JACK'S TRACKS DOES NOT WARRANT THAT (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) ANY DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, JACK'S TRACKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. FOR JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, OUR LIABILITY SHALL BE LIMITED TO THE MINIMUM EXTENT PERMITTED BY LAW.

Indemnity

You agree to indemnify and hold Jack's Tracks harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of this Agreement, or your violation of any rights of a third party.

Force Majeure

Jack's Tracks shall not be liable for any failure or delay in performing its obligations under this Agreement where such failure or delay results from events beyond our reasonable control, including but not limited to acts of God, war, terrorism, labour disputes, internet or infrastructure outages, third-party service failures, or any other event outside our control.

Termination & Cancellation

We may suspend or terminate your account and access to the Service at our discretion. Where possible, we will provide a reason for the termination. Upon termination, your right to use the Service ceases immediately.

You may delete your account at any time from your account settings or by contacting us at jack@jackstracks.app. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.

Severability

If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. If two or more provisions conflict, Jack's Tracks shall have the sole right to determine which provision remains in force.

Non-Waiver

Jack's Tracks' failure to enforce any provision of this Agreement shall not be construed as a waiver of the right to enforce that provision at any time in the future.

Assignment of Rights

You may not assign your rights or obligations under this Agreement without our prior written consent. Jack's Tracks may assign its rights and obligations at its discretion.

Choice of Law

This Agreement shall be governed by the laws in force in the State of Oregon. The offer and acceptance of this contract are deemed to have occurred in the State of Oregon.

Forum of Dispute

You agree that any dispute arising from or relating to this Agreement will be heard solely by a court of competent jurisdiction in the State of Oregon. Where a dispute is eligible for Small Claims Court, you agree to bring it in the Small Claims Court of the State of Oregon rather than a higher court. You agree that the unsuccessful party in any dispute shall be responsible for the reimbursement of the successful party's reasonable attorneys' fees, court costs, and disbursements.

California Users and Residents

Pursuant to California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.

Changes to This Agreement

We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect, via email or a prominent notice on the Service. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
